DECISION

On amendment of and addition to the detailed Regulation for the implementation of
Decrees No.12/CP dated 18 February 1997 and No.10/1998/ND-CP dated
23 January 1998 of the Government issued with Decision No.0321/1998/
QD-BTM of the Ministry of Trade dated 14 March 1998

In order to implement the policy of promotion of foreign investment in Vietnam and simplify further the procedures for preparation of plans for exportation or importation, the Ministry of Trade hereby amends and adds to a number of provisions of the Detailed Regulations for the implementation of Decrees 12-CP dated 18 February 1997 and 10-1998-ND-CP dated 23 January 1998 of the Government issued with Decision no.0321-1998-QD-BTM of the Ministry of Trade dated 14 March 1998 as follows:

I. Documentation:

(a) With respect to Forms 1, 2 and 3:

1. Form 1 to be deleted: plans for exportation or importation submitted by enterprises to the Ministry of Trade or its authorized bodies shall not be required to be accompanied by a report in Form 1.

2. Form 2 on "the list equipment, machinery, supplies, and means of transportation to be imported for formation of enterprise etc."

I - Machinery, equipment, production tools, etc..

The following words "The company should clearly separate each main stage of production and systems of auxiliary machinery and equipment." shall be deleted.

The remainder is still valid.

3. Form 3 on information which is used by the enterprise as a reference or basis for the preparation of an accurate plan for importation of raw materials or exportation and sale of products in Vietnam on the basis of its capacity of production and feasibility study, the report shall not be required to be prepared in accordance with this Form.

(b) With respect to documentation to be submitted to the Ministry of Trade or its authorized bodies as stipulated in article 3.1:

With respect to investment projects for which enterprises are not required to make a feasibility study, they shall only register for an investment license in accordance with article 4 of Decree no.10-1998-ND-CP dated 23 January 1998.

The documentation submitted to the Ministry of Trade or its authorized bodies shall include the documentation for registration for an investment license instead of the feasibility study.

II. Reporting referred to in article 10:

Quarterly reporting shall be deleted and replaced with annual reporting in December as stipulated in clause 3 of article 47 of Decree no.12-CP of the Government dated 18 February 1997.

III. Article 8 - Exemption from import duties in cases where enterprises import materials to produce products which are then sold to other enterprises as materials for direct production of finished products for export:

The following paragraphs "exemptions from import duties shall be dealt with only when the last product has been exported" and "the application file for, and the consideration of, exemptions from duties in respect of the corresponding quantity of raw materials shall be stipulated and dealt with by customs offices" shall be deleted and replaced with the following paragraph "the application file and procedures for exemption from import duties in respect of the corresponding quantity of raw materials shall be stipulated in article 1.4 of Circular no.63-1998-TT-BTC of the Ministry of Finance dated 13 May 1998."

This Decision shall constitute an integral part of Decision 0321-1998-QD-BTM of the Ministry of Trade dated 14 March 1998 and shall be of full force and effect as of the date of its signing.
